· What are the relation between the Union and the States/UTs on this matters; whether the State Government can out rightly can take up the metro rail construction without the involvement of the Railways; if so under what provisions of the Law, or the Constitution; or are there any via media rules to go ahead with the metro rail in place of tramways without any amendments in the Law or without prior sanction and approval of the Parliament or changing the Constitution to suit to the State. These are general topics we discuss, but could not get proper and correct path to move.
HYDERABAD METRO RAIL PROJECT PASSES A MAJOR HURDLE
Hyderabad : The Hyderabad Metro Rail project on Sunday passed a major hurdle with the South Central Railway (SCR) giving clearance to four Metro Rail crossings over the railway tracks in a proposal submitted by the HMR officials.

HYDERABAD METRO RAIL PROJECT PASSES A MAJOR HURDLE

This is the first set of ‘general arrangement drawings’ (GAD) approved by the South Central Railway in a record two months after their submission. This will enable the HMR to build elevated metro rail crossings over the SCR railway tracks at Bharatnagar, Lakdikapul, Malakpet and Begumpet.
“Construction of elevated metro rail structures over the railway tracks is a critical activity determining the progress of the metro rail project and the early approvals accorded by SCR would enable speedy progress of the Metro Rail project,” said Mr N.V.S. Reddy, managing director, HMR.
Given the complex arrangements, technical complications and the legalities of ‘Right of Way’ as per the Indian Railways Act, railway clearance for elevated metro rail crossings over the railway tracks is normally a prolonged affair. The organisations seeking Right of Way permissions over railway tracks have to satisfy the stringent conditions of the Indian Railways codes and rules.
In a meeting with the HMR officials on Sunday, the SCR officials indicated that the approvals for the remaining crossing points at Alugadda Bavi, Chilkalguda, Oliphant Bridge and Wadi end of Secunderabad Railway station (western end) will be cleared shortly.
The railway authorities have accorded approvals for the first four Metro Rail crossings with the condition that proper integration of Metro Rail stations with the nearest railway station shall be achieved by HMR providing walkways, skywalks, parking facilities, etc. They have also stipulated that at Secunderabad station, the nearest Metro Rail station shall be connected to various platforms of the railway station with skywalks and escalators.
Mr N.V.S. Reddy said that the railway safety specifications, vertical (height) and horizontal clearances, infringement regulations etc., would be strictly adhered to.

Whether any provision, amendment, or any other steps taken to apply Act.No:34 of 2009 to Andhra Pradesh State in reference to its Hyderabad Metro Railway’s construction in Hyderabad Metropolitan City . Metro Rail Projects: Are they not coming under the purview of environment and finance related problems wholly started and functioning by the states with out the involvement of the Central Government/Ministry of Railways, and /or they–THE STATES LIKE THE ANDHRA PRADESH STATE- empowered to take up Metro Rails of their own with out the Notification/express sanction of the central Government as laid down in the Central Acts- appertaining to Metro Railways Act,1978;2002 or 2009 and how to encompass the Tramway’s to go as Metro Railways; What shall be the via media when Finance and environmental factors play a vital Role on these issue. Whether any Regulatory has been formed as proposed in 2006.
Can I get copies of the Andhra Pradesh State’s Gaz.Notification or of the Centre and the provisions made for the Hyderabad Metro Rail construction program taken up — provisions ,authority made by the Act or the Acts like that of the Metro Railways Act,2009, or 2002 or 1978 and amendments thereto to apply them for the HMR Project. I have got a copy of AP Tramways Act, which in my considered view, does not apply for the HMR-metro railways; What are the via media/ alternate steps taken in accordance with the Constitution of India, Indian- Metro Railways Acts, of 1978,2002,2009, etc.
